DOT's Final Rule on Oral Fluid Drug Testing Webinar

The Department of Transportation (DOT) has issued a final rule that allows oral fluid testing for employees in the transportation industry. The rule was effective June 1, 2023. Employers should be aware of the new rule and prepare for its implementation by establishing business relationships with oral fluid collectors and labs, either directly or through service agents. They should also have standing orders in place with their collection sites to specify what kind of collection they want performed for regular and observed collections. The final rule includes other changes to 49 CFR Part 40 that employers need to be aware of so they are able to adjust their regulated drug testing programs as needed.
